Act establishing the Expanded Adult Basic Coverage Insurance Program & the Physician Retention Loan Forgiveness Program in the PHEAA; providing for powers & duties of PHEAA, establishing progs. in DPW; making approps. & related repeals.

 

 

PLS Summary:

(PN 2098) The Expanded Adult Basic Coverage Insurance Program Act establishes the Expanded Adult Basic Coverage Insurance Program, which is contingent on federal participation. If the Federal Government enacts programs similar to the program, the program shall be construed to only supplement the Federal programs; and adults qualified for coverage under the Federal program shall utilize that Federal program before utilizing the program. Appropriations to the Insurance Department for the program shall be used for contracts to provide basic health care insurance for eligible adults and administration of outreach activities. The department shall ensure that all eligible adults have access to the program. Participants would pay a monthly premium of up to $50, depending on income. Rates for the program shall be approved annually by the department and may vary by region and contractor. This would not be an entitlement program. The bill provides for the duties of the Insurance Department, for the requests for proposals, and for the duties of contractors. All entities providing health insurance or health care coverage in PA would be required to provide, at least monthly, certain information for persons for whom the entities provide insurance or coverage. The department would use this information to determine whether another entity has primary liability for health care claims paid by the program. If a determination is made that the enrollee or wait-list enrollee has other health care coverage, the eligibility of the enrollee or wait-list enrollee shall be reevaluated, as shall the most cost-effective means of providing coverage for that enrollee or wait-list enrollee. The Pennsylvania Expanded Adult Basic Coverage Insurance Program Fund is established in the State Treasury; $362,000,000 shall be transferred from the Health Care Provider Retention Account to the PA Expanded Adult Basic Coverage Insurance Program Fund, and funds appropriated under section 306(b)(1)(vi) of the Tobacco Settlement Act shall be deposited into the PA Expanded Adult Basic Coverage Insurance Program Fund. Additionally, every hospital plan corporation and professional health service plan corporation operating in PA shall pay the tax on gross premiums payable under Article IX of the Tax Reform Code. The sums received as a result of this tax shall be deposited into the PA Expanded Adult Basic Coverage Insurance Program Fund. This subsection shall not be effective if the Agreement on Community Health Reinvestment entered into February 2, 2005, by the department and Capital BlueCross, Highmark, Inc., Hospital Service Association of Northeastern PA and Independence Blue Cross and published in the Pennsylvania Bulletin is extended or otherwise renegotiated to continue, at least, at the level of Annual Community Health Reinvestment contributed under that agreement. In that event, the sums received by the Commonwealth shall be deposited into the Pennsylvania Expanded Adult Basic Coverage Insurance Program Fund. The legislation also provides for physician retention loan forgiveness in the amount of 10% each year over ten years; establishes the Physician Retention Loan Forgiveness Program in the Pennsylvania Higher Education Assistance Agency; provides for powers and duties of PHEAA and requires health care coverage for telehealth; establishes the hospital electronic information incentive payment program to provide financial assistance to certain acute care hospitals and critical access hospitals for the implementation of electronic health record systems; and establishes the Dentists for Medical Assistance Patients Program in the Department of Public Welfare to help meet the inadequacies of improve care to those on MA to bring dentists into communities where there is a need and to provide an incentive to students to pursue training in dentistry; makes appropriations; and makes related repeals. Act relating to amusement; authorizing table games; imposing powers & duties on the PA Gaming Control Board; providing for eligibility to conduct authorized table games, etc; making appropriations; & making related repeals.

 

 

PLS Summary:

(PN 2187) The Table Game Authorization and Control Act makes legislative findings that it is in the best interests of the Commonwealth to have table games and provides definitions for the Act. The Act authorizes table games for licensed facilities, licensed under Title 4. The Act also gives the Pennsylvania Gaming Control Board the power and duties to regulate and license table games and ensure the integrity of the table games. The Act further allows the Board to perform background checks before licensing and to revoke or deny licenses for lack of good character and other reasons. Also, the Act prescribes certain regulations that must be promulgated by the Board. The Act requires the Board to submit an annual report to the Governor and General Assembly regarding its actions. The Act also requires a licensee to submit a report to the General Assembly and also provides for the maintenance and confidentiality of information received by the Board. The Act authorizes the Board to conduct investigations and annual audits of each licensed table game facility and vests exclusive appellate jurisdiction in the Pennsylvania Supreme Court for all adjudications and licensing determinations of the Board. Furthermore, the Act provides for the eligibility requirements of license applicants and gives the Board authority to issue fees, fines, and penalties on license holders and applicants, as well as provides application requirements for those already holding licenses under Title 4. Also, the Act provides certain requirements for corporations wishing to be licensed and provides for the application procedure for all of those seeking a license. The Act also requires key employees to be licensed by the Board, provides rules for obtaining such a license, and requires the registration of service employees. The Act further requires the licensing of any entity in the table games industry. The Act also provides that the State Police shall conduct investigations as to each applicant for a license and requires an operations certificate before operations can begin at a table games facility, as well a provides for rules regarding the operations of the table games facility. Continuing, the Act limits the facility's ability to issue lines of credit to patrons and requires suppliers and manufacturers of table game supplies to obtain a license from the Board. The Act also places restrictions on junkets and provides for their regulation and provides for the depositing of table game revenues. The Act also allows for the imposition of a table games tax.

(PN 607) The Zero-based Budgeting Act requires the Secretary of the Budget to subject every program in State government to zero-based budget review no less often than once every five years. In order to implement this schedule, approximately one-fifth of the budget shall be subject to zero-based budgeting in each year beginning in 2011. The task force shall develop protocols establishing a statewide response system and a strategic plan related to helping children who may have been endangered by circumstances involving the illegal production of methamphetamine or other drugs or by trafficking or abuse. PLS Summary:

(PN 705) The One Pennsylvania Act requires the Office of Administration to establish a pharmacy benefits consolidation program. The program shall administer all publicly funded Commonwealth prescription drug plans through an integrated system of plan administration using uniform standards and requirements for the reimbursement to providers. The legislation provides for requirements; establishes Special Pharmaceutical Fund; provides that all money appropriated from the State Lottery Fund for PACE and all federal and state money allocated for pharmaceutical purchasing or reimbursement will be transferred to the Special Pharmaceutical Fund; requires that pharmaceutical manufacturers must enter into a rebate agreement with the department to obtain reimbursement for prescription drugs.

(PN 727) The Community-Based Health Care Provider Assistance Act creates the Community-Based Health Care Provider Assistance Program to provide grants to community-based health care providers to improve the access to and quality of health care PA. The program would be administered by the Department of Health, which would seek Federal matching funds under medical assistance, as well as grants and funding from other sources, to supplement amounts made available under this act. The bill creates the Community-Based Health Care Provider Assistance Fund and states that $22,000,000 would be transferred annually from the Health Care Provider Retention Account to provide grants to community-based health care providers. A community-based health care provider that receives a grant under this act would report at least annually to the department.

Each criminal justice agency using the database shall do all of the following: (1) Identify a system administrator responsible for annually auditing the use of the system within his respective agency to ensure agency compliance with policies established for the use of the database; (2) Ensure that all users of the database receive training on the use of the database before granting the users access to the database; (3) Ensure that any information entered into the database relates to a criminal street gang associate or gang member who is 12 years of age or older; and (4) Annually produce a gang threat assessment report including available data sources such as uniform crime reports, record management systems and entries into the Statewide gang database.

At least 95% of the funds to the board shall be allocated for grants.

A person having reasonable cause to believe that an adult is in need of protective services may report such information to the local contracted provider of protective services. The bill provides for guidelines for a local contracted provider of protective services investigation, immunity from civil and criminal liability for an agency, its director and employees, protective services workers or employees; requires information contained in reports, records of investigation, assessment and service plans shall be considered confidential and be maintained under regulations promulgated by the department to safeguard confidentiality; provides for involuntary intervention by emergency court order; establishes rights of protective services clients; provides for reporting requirements by employees; and provides for civil and criminal penalties.

Loan forgiveness awards may be made to the extent that funds are appropriated by the General Assembly or available from other sources and are sufficient to cover the administration of the program. If funding is insufficient to fully fund the administration and all eligible applicants, priority shall be given to renewal applicants, after which point, a random lottery system is prescribed for determining which applicants receive loan forgiveness awards. The bill outlines the responsibilities of PHEAA and provides for an annual report to be submitted to the General Assembly.

The department shall convene within 60 days an advisory committee that includes a police chief, school superintendent, school principal, district attorney, solicitor of a school district, an in-school probation officer, special education supervisor, special education advocate and one designee each from the department, the PA Commission on Crime & Delinquency, the Municipal Police Officer's Education and Training Commission, the Juvenile Court Judges Commission and the Pennsylvania State Police to develop the forms to be used by school entities to report school violence statistics, a model memorandum of understanding and make recommendations on training procedures and programs that prevent and combat school violence. Each chief school administrator shall be required to report certain information on all incidents involving acts of violence, possession of a weapon or possession, use or sale of controlled substances, or possession, use or sale of alcohol or tobacco by any person on school property at least once a year. The bill provides for the form of reporting. Provides targeted grants shall be allocated through a competitive grant review process established by the office. The legislation also provides for duties of each chief school administrator and each police department with jurisdiction. Each chief school administrator shall enter into a memorandum of understanding with police departments having jurisdiction over school property of the school entity. Provides the department may initiate disciplinary action against a chief school administrator or principal of a school entity who intentionally fails to submit the report as or enter into the memorandum of understanding. PLS Summary:

(PN 91) The Subsidy Guardianship Program Act would require the Department of Aging to establish a subsidized guardianship program for the benefit of children in legal custody of a county children and youth services (CYS) agency. The subsidy would continue until the child reaches 18 years of age. The grandparent or relative caregiver receiving a guardianship subsidy would submit annually to the department a sworn statement that the child is still living with and receiving support from the guardian. The bill adds that a grandparent or other relative caregiver may request appointment as guardian and obtain legal custody over a child and receive a guardianship subsidy from the department. Prior to a guardianship hearing and as a prerequisite for payment of a guardianship subsidy, a home study report on the grandparent or relative caregiver would be filed with the court having jurisdiction over the child's case within 15 days of the request for a subsidy. Lastly, the department would seek any Federal waiver necessary and appropriate to implement the act.

Insurers would also provide participating physicians with updates to the fee schedule as modifications occur. When a participating physician performs more than one surgical procedure on the same patient and at the same operative session, insurers would pay the participating physician the greater of the amount calculated on the basis of the applicable insurer fee schedule. The legislation provides for penalties if the insurer fails to provide a participating physician with a copy of the fee schedule and updates to the fee schedule in the time frame or fails to adhere to the policy for payment of multiple surgeries.

The actions would be brought in the court of common pleas, which would have jurisdiction to issue temporary, preliminary or permanent injunctive or other equitable relief. The bill also provides for the following: notice to interested parties, continuances, issuance and enforcement of preliminary orders, notification and provision of treatment resources, premises involving multiple residences or businesses, vacating or modifying closing order, permanent injunction and other relief, closure, penalties, settlements, recovery of costs and liens. Persons issued ignition interlock licenses under this section shall be subject to rolling tests after the vehicle has successfully been started using the ignition interlock system.

Each slot machine licensee shall pay from its daily gross table game revenue from the table games in operation at its licensed facility a tax of 12% to be deposited into the General Fund, and a local share of 2%. Category 3 licensees shall pay a one time fee of $7.5 million and be subject to the same tax rates. Category 1 and 2 licensees may own up to 250 tables. Category 3s may own 25 table games and 10 nonbanking poker tables with no more than 10 players at each table.
